Terms and Conditions of Sale


1. Introduction

These terms and conditions ("Terms") govern the sale of bespoke manufactured items ("Products") by Overland Products ("Seller," "we," "us," or "our") to customers ("Buyer," "you," or "your") through our online platform ("Website"). By placing an order through our Website, you agree to be bound by these Terms.


2. Orders and Customization

2.1 All orders are subject to acceptance by the Seller.

2.2 Products are made-to-order and customized according to the Buyer's specifications. It is the Buyer's responsibility to provide accurate and complete customization details.

2.3 Changes to orders must be requested within 24 hours from the time the payment was made. This time is determined by the timestamp on the payment processing system.

2.4 The Seller reserves the right to cancel any order at any point for any reason. In such cases, a full refund will be provided to the Buyer.

2.4.1 Refunds processed for such cases may be subject to currency fluctuations. Due to potential changes in the exchange rate between UK pounds sterling (GBP) and the currency of the Buyer's payment method, the refunded amount in the Buyer's payment method currency may be slightly more or less than the original payment amount received.


3. Pricing and Payment

3.1 All prices are quoted in UK pounds sterling and include any applicable taxes.

3.2 Payment must be made in full at the time of order placement. Payment methods accepted will be outlined on the Website.


4. Manufacturing, Delivery, and Courier Services

4.1 The manufacturing process will commence upon receipt of payment.

4.2 Estimated manufacturing and delivery times will be provided to the Buyer. Delays may occur due to unforeseen circumstances, including but not limited to supplier delays, shipping disruptions, or force majeure events. The Seller shall not be liable for any such delays.

4.3 Delivery will be arranged through reputable courier services. The Seller will provide tracking information to the Buyer upon dispatch.

4.4 Delivery will be deemed completed when the courier confirms the Products have been delivered to the Buyer's provided address, any alternate delivery address designated by the Buyer, or any other location the courier deems appropriate (such as a safe place, neighbor, or similar). Upon such confirmation, risk of loss or damage passes to the Buyer.

4.5 The Seller is not responsible for courier notification methods (such as “carding,” email, SMS, or tracking updates) or the courier’s subsequent delivery procedures.

4.6 The Buyer assumes all risks, costs, and consequences arising from alternate delivery arrangements as handled by the courier.

4.7 Any disputes or issues regarding delivery status or location must be addressed directly with the courier’s customer service team.

4.8 For international deliveries, import duties, VAT, customs fees, and any other charges imposed by the destination country are the sole responsibility of the Buyer. The Seller is not responsible for calculating, collecting, or remitting such charges.


5. Cancellations and Refunds

5.1 Due to the customized nature of the Products, cancellations are not permitted.

5.2 Refunds will only be issued if the Products are faulty, damaged upon delivery, or fail to meet the Seller’s specifications. Any claims for faulty or damaged Products must be made within 14 days of delivery and accompanied by reasonable evidence such as photos.

5.3 Refunds requested for reasons outside clause 5.2 will be subject to an administration charge equal to the payment processor’s fees (typically 1.5% + £0.20 for UK cards or 2.5% + £0.20 for international cards). The Buyer will be notified of the refund amount before processing.

5.3.1 Refunds for UK customers who select collection during checkout (when this option is unavailable) will incur a £15 administration fee deduction.

5.4 Any direct costs incurred by the Seller related to the return or refund process will be deducted from the refund amount.


6. Liability and Disclaimers

6.1 Limitation of Liability
The Seller’s total aggregate liability to the Buyer (whether in contract, tort—including negligence—breach of statutory duty, or otherwise) shall not exceed the purchase price actually paid by the Buyer for the specific Product(s) giving rise to the claim.


6.2 Exclusion of Indirect & Consequential Damages
To the fullest extent permitted by law, the Seller shall not be liable for any:
(a) Indirect, incidental, consequential, punitive, or special damages (including but not limited to lost profits, loss of business opportunity, business interruption, anticipated savings, reputational harm, or vehicle downtime);
(b) Claims arising from third-party actions (e.g. installer errors, shipping damage);
(c) Personal injury, property damage, or economic loss resulting from misuse, incorrect installation, or failure to follow the Seller’s instructions or guidelines.
This exclusion applies even if such damages were foreseeable or the Seller had been advised of their possibility.


6.3 Buyer’s Sole Responsibility
The Buyer accepts sole responsibility for the following, and acknowledges that the Seller shall have no liability arising from:
(a) Providing accurate measurements, specifications, and customization details;
(b) Verifying compliance with all applicable local laws, regulations, and standards in the Buyer’s jurisdiction (e.g. U.S. state safety or emissions laws).


6.4 Professional Installation Mandatory
(a) Installation must be carried out by a qualified professional holding:

  • A Level 2 NVQ in Automotive Glazing (UK); or
     
  • An equivalent, verifiable credential (e.g. ASE Certification (U.S.), IGA Accreditation, or any nationally recognized automotive glazing standard).
     

The Buyer must submit proof of installer certification to the Seller in writing prior to installation. Installation may not proceed unless and until the Seller has reviewed the submitted credentials and confirmed in writing that they are acceptable.

(b) If installation is performed by an unqualified person, all warranties are void. The Seller shall bear no liability whatsoever for any damage, loss, injury, death, or other consequence arising directly or indirectly from the installation, use, misuse, or continued operation of the Product(s), regardless of when such issues arise.


Warning: Incorrect or improper fitting of the Product(s), particularly vehicle glazing components, may compromise the structural integrity, safety, and performance of the installation. The Buyer assumes full responsibility for any damage, injury, or failure resulting from incorrect, unapproved, or non-compliant installation, whether performed by the Buyer or any third party. The Seller disclaims all liability in such cases.

6.5 No Liability for Third Parties
This agreement is strictly between the Seller and Buyer. It creates no rights under the Contracts (Rights of Third Parties) Act 1999 or any equivalent doctrine in other jurisdictions, including third-party beneficiary claims.


7. Exclusion of Right to Cancel Under Distance Selling Regulations

The Buyer acknowledges that, in accordance with the customized nature of the Products being made to order, the statutory right to cancel orders within the 14-day cooling-off period as provided by the UK Distance Selling Regulations may not apply.

This exclusion is applicable due to the personalized and unique nature of the Products, which are tailored to the Buyer's specific requirements and cannot be easily resold.


8. Governing Law, Jurisdiction, and Modifications

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales, excluding its conflict-of-law principles.

The parties agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any disputes.

The Buyer waives any right to a jury trial to the extent permitted by law.

The Seller reserves the right to modify these Terms at any time. Updated Terms will be effective immediately upon posting on the Website. It is the Buyer’s responsibility to review the Terms periodically.

We are a small, customer-focused business committed to sorting out any issues you may have.


While these Terms and FAQs are designed to protect us from problematic transactions, we want you to feel confident ordering from us. If anything goes wrong or you have questions, just reach out — we’ll do our best to help.


Because our Products are custom-made, they cannot be returned unless faulty. If you accidentally order a window that opens the wrong way, we may be able to help with an exchange, but you’ll need to cover the return and replacement shipping costs, and this depends on stock availability.
