Terms and Conditions of Sale
1. Introduction
These terms and conditions ("Terms") govern the sale of bespoke manufactured items ("Products") by Overland Products ("Seller," "we," "us," or "our") to customers ("Buyer," "you," or "your") through our online platform ("Website"). By placing an order through our Website, you agree to be bound by these Terms.
2. Orders and Customization
2.1 All orders are subject to acceptance by the Seller.
2.2 Products are made-to-order and customized according to the Buyer's specifications. It is the Buyer's responsibility to provide accurate and complete customization details.
2.3 Changes to orders must be requested within 24 hours from the time the payment was made. This time is determined by the timestamp on the payment processing system.
2.4 The Seller reserves the right to cancel any order at any point for any reason. In such cases, a full refund will be provided to the Buyer.
2.41 Refunds processed for such cases may be subjected to currency fluctuations. Due to potential changes in the exchange rate between UK pounds sterling (GBP) and the currency of the Buyer's payment method, the refunded amount in the Buyer's payment method currency may be slightly more or less than the original payment amount received.
3. Pricing and Payment
3.1 All prices are quoted in UK pounds sterling and include any applicable taxes.
3.2 Payment must be made in full at the time of order placement. Payment methods accepted will be outlined on the Website.
4. Manufacturing, Delivery, and Courier Services
4.1 The manufacturing process will commence upon receipt of payment.
4.2 Estimated manufacturing and delivery times will be provided to the Buyer. Delays due to unforeseen circumstances may occur, and the Seller will not be liable for such delays.
4.3 Delivery of the Products will be facilitated through reputable courier services. The Seller will provide the Buyer with tracking information upon dispatch.
4.4 Once the courier confirms the delivery of the Products to the Buyer's provided address, any alternate delivery address designated by the Buyer, or any other delivery address that the courier has seen fit to deliver to, it will be considered delivered, and the risk of loss or damage will transfer to the Buyer.
4.5 Notification of alternate delivery arrangements, as per normal courier practices, may include methods such as "carding" (a physical notification card left at the delivery address), email, SMS, or tracking updates. The Seller will not directly manage these notifications, and the Buyer may not be directly engaged in the courier's subsequent delivery procedures.
4.6 The Seller holds no responsibility for issues arising from these alternate delivery arrangements, as they adhere to the courier's policies and practices.
4.7 Any additional costs, risks, or consequences associated with alternate delivery arrangements shall be the Buyer's responsibility.
4.8 The Seller will consider the Products delivered upon confirmation by the courier to the Buyer's provided address, any alternate delivery address designated by the Buyer, or any other delivery address that the courier has seen fit to deliver to. Any discrepancies or issues with delivery status must be addressed with the courier's support team.
4.9 International Deliveries and Import Charges
For international deliveries outside the United Kingdom, payments made and orders placed could be subject to import duty and VAT in the destination country. The responsibility for these charges, if applicable, lies with the Buyer. The Seller is not responsible for the calculation, collection, or remittance of such charges.
5. Cancellations and Refunds
5.1 Cancellations are not possible due to the customized nature of the Products.
5.2 Refunds will not be issued unless the Products are faulty, damaged, or do not meet the seller's specifications.
5.3 Refunds made for reasons outside 5.2 will be subject to an administration charge equal to the payment processors free. Typically 1.5% + 20p for UK Cards OR 2.5% + 20p for International Cards.
5.4 Any direct costs incurred by Us will be deducted from any refund. Whatsoever they may be.
6. Liability and Disclaimers
6.1 The Seller's liability is limited to the purchase price of the Product.
6.2 The Seller shall not be liable for any indirect, consequential, or incidental damages arising out of the sale or use of the Products.
6.3 The Seller shall not be liable for any delays, errors, or inaccuracies related to the customization details provided by the Buyer.
7. Exclusion of Right to Cancel Under Distance Selling Regulations
The Buyer acknowledges that, in accordance with the customized nature of the Products being made to order, the statutory right to cancel orders within the 14-day cooling-off period as provided by the UK Distance Selling Regulations may not apply.
This exclusion is applicable due to the personalized and unique nature of the Products, which are tailored to the Buyer's specific requirements and cannot be easily resold.
8. Governing Law and Jurisdiction
8.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.
8.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Modifications
9.1 The Seller reserves the right to modify these Terms at any time. Changes will be effective upon posting on the Website.
